Terms and Conditions

Welcome to Save All Day (Pty) Ltd ("Save All Day", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and advertiser portal (collectively, the "Platform").

By accessing or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, please refrain from using the Platform.

1. Definitions

  • "User" means any individual accessing or using the Platform.
  • "Retailer", "Advertiser" or "Brand" means a business entity advertising goods or services via the Platform.
  • "Platform" means the website, mobile site (if applicable), advertiser portal, and related tools and services provided by Save All Day.
  • "Homepage Banner" refers to Save All Day's premium digital billboard placement.
  • "Listing" means any promotional content uploaded by a Retailer.

2. Eligibility

By using the Platform, you represent and warrant that you are:

  • At least 18 years old;
  • Legally capable of entering into a binding agreement;
  • Providing truthful, complete, and accurate information.

3. Platform Use

You agree to use the Platform only for lawful purposes. You may not:

  • Use the Platform to infringe on the rights of others;
  • Upload malicious software or engage in data scraping, mining, or unauthorized automation;
  • Attempt unauthorized access to the Platform or associated systems;
  • Interfere with or disrupt the integrity of the Platform.

4. Retailer-Specific Terms

Minimum Discounts:

  • Products (non-vehicles): Minimum 9% discount required.
  • Vehicles: Minimum 5% discount required.
  • Non-compliance may lead to removal of listings or account suspension.

Homepage Banner Ads:

  • May be used to advertise competitions, combo deals, flash sales, seasonal promotions and limited-time offers.
  • Banner content must align with Save All Day's advertising standards and may be subject to approval prior to going live.
  • Subject to pre-payment terms (see Section 5).

Image Limits: Up to 5 images per product listing.

Restricted Products: Firearms and ammunition are strictly prohibited.

Listing Accuracy: Retailers must ensure listings reflect actual stock and current pricing.

Instant Listing Activation: Product listings go live immediately upon upload by the Retailer.

5. Retailer Payment Terms

Billing Frequency: Monthly for listings and subscriptions.

Homepage Banner:

  • Registered Retailers: Payment due within 30 days.
  • Unregistered Retailers: Immediate payment and proof required before activation.

Payment Terms:

  • Payment is due within 7 days of invoice.
  • A reminder is sent on Day 3 of non-payment.
  • Account may be suspended after Day 7.

Sign-Up Fee: Non-refundable, once-off fee applicable to all new Retailers.

Accepted Payment Methods: As listed on the invoice.

6. Pricing Structure

Advertising fees are based on:

  • Product section (e.g., vehicles, home & living, food & drinks);
  • Number of listings;
  • Duration (daily rate).

Save All Day reserves the right to revise pricing with reasonable notice to all Retailers.

7. Stock Availability Requirement

  • Retailers must ensure that all listed products are currently in stock and available for purchase at the time of listing.
  • Listings for out-of-stock items are strictly prohibited and may result in content removal or account suspension.
  • Retailers are responsible for updating or removing listings promptly if stock becomes unavailable.

8. Intellectual Property

All content, software, graphics, logos, and branding on the Platform are owned by Save All Day or its licensors. Retailers and Users may not copy, reproduce, or use such materials without prior written consent.

9. Account Security

Users are responsible for maintaining the confidentiality of their login credentials. You must notify us immediately of any unauthorized access.

10. Data Protection and Privacy

We comply with the Protection of Personal Information Act (POPIA). By using the Platform, you consent to the collection, processing, and storage of your personal data as outlined in our Privacy Policy.

11. Content Standards and Prohibited Conduct

Retailers must ensure that listings:

  • Are accurate, complete, and not misleading;
  • Do not contain offensive, defamatory, or discriminatory content;
  • Comply with applicable laws and advertising regulations.

We reserve the right to remove any content at our sole discretion.

12. Termination of Access

We reserve the right to suspend or permanently deactivate any account that violates these Terms, our content standards, or applicable laws.

13. Disclaimers and Limitation of Liability

  • The Platform is provided "as is", without warranty of any kind.
  • Save All Day shall not be liable for indirect, incidental, or consequential damages, including loss of income or business opportunity.

14. Indemnification

You agree to indemnify and hold Save All Day (including its directors, employees, and affiliates) harmless against any claims or liabilities arising from:

  • Your use or misuse of the Platform;
  • Your violation of these Terms or applicable laws;
  • Content you submit or upload.

15. User-Generated Content Rights

By uploading content to the Platform, you grant Save All Day a non-exclusive, royalty-free, worldwide license to use, reproduce, and display such content for marketing and promotional purposes.

16. Third-Party Links and Services

The Platform may contain links to third-party websites or services. Save All Day is not responsible for the content, terms, or privacy practices of such external sites. Use of third-party tools is at your own risk.

17. Marketing Communications

By registering on the Platform, you consent to receive marketing communications from Save All Day. You may opt out at any time by following the unsubscribe link in our emails.

18. Cookies and Tracking

We use cookies and similar tracking technologies to improve user experience and analyze traffic. By continuing to use the Platform, you consent to the use of such technologies in accordance with our Privacy Policy.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute shall be resolved in the courts of South Africa, which shall have exclusive jurisdiction.

20. Notices and Communication

All notices to Save All Day should be sent to support@saveallday.co.za.

21. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
